Current Community Topics:
- Legal "Dispute Resolution Request"
- Description of Issue:
- The current legal question before the Board is a “Dispute Resolution Request” as a result of the Board’s failure to respond to several written requests to meet. The objective of the meeting is to address several different issues and look to establish some middle ground for resolution. An example of one such issue is the ARC Appeal submitted in November 2009 seeking to address several ARC procedural problems.
The Colorado Common Interest Ownership Act or CCIOA which governs all HOA’s in Colorado mandates a multitude of processes and procedures be implemented and followed in all HOA’s including one for Mediation, Arbitration and or Litigation. The goal of this act is the ability to sit with a mediator to address issues within the community at an owners request to negate the need for litigation. After several failed attempts to meet with the Board as community members this is being requested through legal counsel.
The goal is for the processes and procedures defined in the documents that established the Watkins Farm Homeowners Association be followed. Their consistent application provides the roadmap for understandable and amicable outcomes now and in the future. Dispute management and clarification of intent are core provisions.
A key element in moving this community forward will include our ability to sit across from one another, in disagreement, communicate professionally, set our personal biases aside, and reach compromises that serve all of us as residents of Watkins Farm. - Watkins Farm Board of Director's Resolution Regarding Dispute Resolution Policy and Procedures
